BIG SCARY T&CsThis is where we're gonna talk about the stuff that protects both of us. It'll look big and complicated, but I promise it's not!From this point onwards, the client refers to - well, you - the person purchasing the commission. The artist refers to me, Rubicon-Art, who will be doing the commission art.

The terms and conditions laid out below are considered to be in effect once an agreement on a commission is reached. No financial transaction will take place until the artist and client have reached an agreement, at which point the T&Cs will come into effect.All prices are in GBP (£). It is the client's responsibility to make sure they have the correct converted amount if they use a different currency.For pieces £5 and under, payment is upfront. For pieces over £5, half of payment will be upfront, hereby referred to as the deposit, the other half upon completion.Payment will be sent through PayPal invoice, from the artist to the client.Depending on the complexity of the piece, the artist may incur additional fees. These will be laid out for the client before an agreement is made, and the client retains the right to cancel if they do not wish to pay the additional fees, as long as they request cancellation before an agreement is made.NO REFUNDS will be given once art is in production. Exceptions will be given if the artist feels they are unable to complete a piece within a reasonable timeframe. The client may back out before the piece is completed, given they give reasonable warning, but the deposit will not be refunded.For pieces above sketch, the sketch will be sent to the client for any feedback and/or requested edits or changes. Extensive edits may incur a fee, though this will not be applied until the client agrees. In the event the client is unhappy with the piece, and cannot reach an agreement with the artist on edits, they are able to cancel the commission. The deposit will not be refunded, nor will any editing fees if the edits have already taken place, but the client will not be required to pay the remaining half.Once the piece is complete, a screenshot will be sent to the client. Upon receiving payment for the final half, the client will receive an email of the original piece in full quality.A client is allowed to request edits up to completion, however, anything beyond minor edits past this point may require further payment.
The artist will decide what constitutes a complex enough edit to incur fees.Transparent and simple gradient backgrounds are offered as a courtesy on all pieces.If the client does not pay the remaining half upon completion within 7 working days, the artist reserves the right to contact PayPal in an attempt to resolve the situation and receive the payment. Extensions to the payment deadline may be made if the client discusses it with the artist in advance.The artist reserves the right to cancel a commission due to lack of communication from the client, or rude or inappropriate behaviour. Any breach of these Terms of Service will also warrant cancellation.
In this situation, the deposit will not be refunded.If the client is difficult to work with - for example, lack of communication, rude/inappropriate behaviour, unexplained delays in payment, or breaching the usage rights, or any of the other terms of service - the artist reserves the right to blacklist them, and refuse to offer commissions to them again.SECTION TWO: RIGHTS AND USAGEThe client has the right to use the commission for personal, non-commercial use only. The client is only allowed to reproduce the piece if it is for personal and non-commercial use (for example, printing said piece to have a physical copy).Rights for further use may be available with discussion.The client may post the commission on their personal profiles, and/or use as an icon or cover image, only if the artist is properly credited and linked to. In this case the artist's username (rubicon-art) must be prominently displayed, along with a link to the artist's page (twitter.com/rubiconart). In the case the client knows the artist personally, use of the artist's name is allowed instead of the username, though linking to the artist's page is still required.The artist retains the rights to the commission, and may use for purposes including but not limited to: posting on their site, use in portfolios or other collages, business cards, websites and for promoting their work. The piece will not be posted anywhere until the client has confirmed they have received it. If the client does not wish for their piece to be posted publicly, they must inform the artist of this before the agreement of a commission is made. If this request is made after completion, the artist cannot promise to uphold it.However, the artist will not sell further copies or profit from commissions containing original characters.The client may not use the commission for any purposes that would be hateful, offensive, or in any way would discredit the artist's reputation.Acceptance and payment of the paypal invoice constitutes legal agreement to these terms.
